BIS consultation on moving Land Registry operations to the private sector

We have set out a number of concerns with the proposal to have a private profit-maximising body operating the Land Registry, as this could lead to disruptions in the registration process and affect the wider property market.

The BSA response to the consultatation by the Department for Business, Innovation and Skills can be found here in which we expressed concerns with the proposals on a number of grounds, including that the move could:

  • Undermine confidence in the accuracy and integrity of the data;
  • Lead to conflicts of interest as the company operating the Land Registry would also have a commercial interest in the registry data;
  • Likely lead to an increase in fees;
  • Reduce accountability of the service to its customers and wider stakeholders;
  • Increase the risk of fraud
